Happy Halloween LSAT Prep studiers! One of my favorite holidays is Halloween (a.k.a All Hallow’s Eve). So to commemorate the eve of All Hallow’s Eve, I've decided to discuss some last minute legally themed Halloween costumes. This way you will not only finally have a costume idea for tomorrow, but will also look really witty and legal-minded while donning it.

Bear Arms
The Second Amendment to the United States Constitution protects the right of the people to keep and “bear arms” from infringement. It was adopted on December 15, 1791 along with the rest of the Bill of Rights. So, why not get a pair of detachable brown or black sleeves, glue on some fake fur and claws, and get your very own pair of bear arms. Get it? -
Row” v. Wade
Roe v. Wade is a very important decision on abortion made in 1973 by the United States Supreme Court. The Court ruled 7-2 that a right to privacy under the due process clause of the Fourteenth Amendment extended to a woman’s decision to have an abortion, but that right must be balanced against the state’s two legitimate interests in regulating abortions: protecting prenatal life and protecting women’s health. So you’re going to need a partner for this costume. One can be “Row,” and must construct a canoe, either out of cardboard or papier-mâché and have a paddle with them. The other can cut a hole in a piece of cardboard big enough to fit through and draw water onto the surface so it looks like they are wading in the water. Do you see? -
Grandfather “Claus”
A grandfather clause is a provision in which an old rule continues to apply to some existing situations, while a new rule will apply to all future cases. So all you have to do is dress up like Santa Claus, but make yourself look older, possibly with a cane and a back hunch. So…you’re Santa Claus, but older so you’re “Grandfather Claus.” *Cue drum roll* -
Salt” & Battery
Assault and Battery is a combination of two violent crimes one can be charged with. Assault is the threat of violence and battery is physical violence. This is another partner costume. One can dress up like a saltshaker, therefore, playing the role of “salt.” The other can dress up like a battery. -
Original Intent
Original intent is a theory in law concerning constitutional and statutory interpretation. Original intent maintains that in interpreting a text, a court should determine what the authors of the text were trying to achieve, and to give effect to what they intended the statute to accomplish, the actual text of the legislation notwithstanding. Okay, so you need to get a very small single-sized tent from REI or wherever. Remember, it needs to be very small and cozy. Then make a cut-out in the top, big enough for your head to fit through, and two cut outs near it for your arms to fit through. On the floor of the tent should be a hole to fit your torso. On your torso you need to wear a sign that says “original.” Now step into the tent and place your torso, head and arms through the holes you’ve cut. Thus, you are an “original” in a tent. See what I did there?
Alright, I’m sure this got your creative juices flowing and you can probably come up with a few more ideas. So, if you don’t like these, go ahead and dress up in your own “quippy” legal costume. Or, I mean you could be boring and dress up as something rote like a witch or a ghost. But, I hope you don’t. Take a break from your LSAT prep tomorrow or this weekend, and celebrate the holiday in style in your cool new costume.
Happy Halloween and Happy Studying!
