Why would A be incorrect? I assumed that the realists were just a sub group of legal scholars...

I think it is a fine assumption that realists are a subgroup of legal scholars, but there are other problems with answer A. For instance, we are told that there is a “traditional” point of view that is explained. Nothing in the passage really tells us that there is a “traditional” view. Instead, we get indicator words like “current” (line 1) and “earlier group” (referring to realists, line 9). So at most we have a temporal relationship, rather than a traditional/non traditional relationship.

Another problem is that answer A says that “problems arising from it are described.” I don’t know that the passage is really describing “problems arising” from either the current or realist view, whichever you interpreted “traditional” to mean. Instead, the majority of the passage talks about problems that scholars in the realist school saw wither the legal system: damaging indeterminacy, leeway of judges, etc. These are problems with the legal system, not problems arising from the VIEW itself. Does that make sense?

The correct answer is (D). The passage discusses two viewpoints in brief -the current view and the "realists" and then goes on to discuss one of those viewpoints - the "realists" - at greater length.
