Yup, that's exactly right. We need evidence in the passage to pick an answer choice, and there's no support for (D). Not only this, but the last sentence of the passage suggests that lawyers (probably not purposefully) actually help prevent judges from minimizing jury inferential error. We're told that judges have a primitive concept of jury inferential error because they ignore the research and conclusions of psychologists in favors of notions about cognition held by lawyers. Those notions held by lawyers are presumably getting in the way of minimizing jury inferential error, which is another strike against (D). Hope this helps!
