Hi LSAT Max, I chose (D) and was wondering why it would be incorrect. Does the flaw lie in the phrase "not unique" when Jorge only talks about "unique" works of art? Thanks!

Thanks for the question! Shanna’s point is that owners can destroy any work of art they own in virtue of their ownership if, for example, caring for it becomes inconvenient. Jorge, on the other hand, believes that from a moral perspective, certain pieces of art—unique artworks—must be preserved, even if the legal owner wants to destroy it. We’re looking for an answer choice Shanna and Jorge have to disagree about.

Now take a look at (D). (D) tells us that if a piece of sculpture is not unique, the owner has no ethical obligation to preserve it if doing so proves burdensome. This is exactly Shanna’s point—that the owner has no ethical obligation to preserve a piece of art if it becomes inconvenient, or proves burdensome. This is also not inconsistent with Jorge’s view, since Jorge thinks that unique artworks should be exempt from destruction, but doesn’t talk about non-unique artworks. Jorge may or may not agree with (D), but Jorge is definitely not committed to opposing (D). Thus, (D) is consistent with both viewpoints and is incorrect. Hope this helps!
