I am confused why E is the correct answer. The book "failing to refer to that critic" is the same as "no such problem exist[ing]" in the stimulus?

Here is a phrase that was helpful to me in my LSAT preparation:

"A lack of evidence is not the same as evidence against."

Here is a common example:

"We have never made contact with aliens, therefore we are alone in the universe."

This is questionable reasoning. The absence of evidence for alien life is not enough to conclude that there is no alien life. The question you asked about makes a similar error.

Your assessment is correct.
no such problem exists = fails to refer to that critic = no alien life

The audit checked only the firms accounts, but made a broad conclusion about tax avoidance.

The book examination checked only the index, but made a claim about the whole book.

There is a lack of evidence for aliens in our solar system, but I made a claim about the whole universe.
