I picked D
The way D is worded is confusing. It reads "it is cited as a fact" whereas the passage indicate "...criticism overlooks the fact..." then the answer continues with "...supporting the critics of the view that capital punishment for theft was an essential part of the labor discipline of British capitalism." As noted on the first opening sentence of the passage. Can someone help me understand this answer better?

(D) is basically just telling us that the critics use this fact in their argument. But, as mentioned above, it’s actually the sociologists who use it, and that’s why (D) is wrong. This distinction is used by the sociologist, which is what (E) tells us.
