From reading the passage, you should’ve gotten the feeling that the author generally thinks that although SCOTUS has had some negative impacts, there’s been more positive than people might think. So (E) says that its treatment was harmful only in a few minor cases, but is this true? Take a look at the beginning of the second paragraph, which says that their decisions weren’t “wholly detrimental on the larger, more important issues.” Implying that there were negative effects on important issues, which goes against (E), ruling it out.
