Hypothethical as a Flaw?

Im confused here. I saw the previously written explanation for the question but I feel like there are several Errors in Reasoning, dialogue-based questions where the second person responds with an example of something that may in fact be hypothetical and the hypothetical nature of their rebuttal is not the flaw. Why is that the case here?
