Common Questions About the MPRE.

What states/jurisdictions require the MPRE?

The MPRE is required for admission to the bars of all but three U.S. jurisdictions (i.e. Maryland, Wisconsin, and Puerto Rico). Since the MPRE requirements vary from one jurisdiction to another, examinees are advised to check with the board of bar examiners in each jurisdiction where admission is being.

Who administers the MPRE?

The Multistate Professional Responsibility Examination (MPRE) is administered by the Law School Admission Council (LSAC) on behalf of the National Conference of Bar Examiners (NCBE).

The MPRE is based on the law governing the conduct of lawyers, including the disciplinary rules of professional conduct currently articulated in the American Bar Association (ABA) Model Rules of Professional Conduct, the ABA Model Code of Judicial Conduct, and controlling constitutional decisions and generally accepted principles established in leading federal and state cases and in procedural and evidentiary rules.

When are the MPRE scores released?

MPRE scores are generally released within five weeks from the date of your examination.

Your MPRE score will be posted to your NCBE Account File Cabinet.

How is the MPRE score calculated?

MPRE scores are reported on a scale ranging from 50 (low) to 150 (high).

Passing scores are established by each jurisdiction—75 is the lowest passing score (Alabama, DC, Georgia, Kentucky, Mississippi, New Jersey, Oklahoma, Pennsylvania, South Dakota, Tennessee, West Virginia and Wyoming) while 86 is the highest passing score (California). The most common passing score is 85.

In terms of how your raw score is scaled, unfortunately it is not black and white.

The reason for this is that MPRE scaled scores are calculated by the NCBE based on a statistical process known as equating that is commonly used on standardized examinations. This statistical process adjusts raw scores on the current examination to account for differences in difficulty as compared with past examinations.

Translation? The MPRE is curved to help ensure that you are not unfairly penalized (or rewarded) for taking a more (or less) difficult version of the exam.

Since we know that is not helpful in any way, here is a good rule of thumb you can use as you try to determine the number of questions you need to get correct.

Assume every MPRE question you answer correctly is worth three points, round up and then add one additional correct answer just to be safe. So in California, you would need to get 30 of the 50 scored questions correct to achieve the scaled score of 86.

Here are the calculations: 86/3 = 28.67 rounded up to 29 and then add one more question to get to 30.

What are the MPRE topics?

The purpose of the MPRE is to measure the examinee’s knowledge and understanding of established standards related to a lawyer’s professional conduct; the MPRE is not a test to determine an individual’s personal ethical values. Lawyers serve in many capacities: for example, as judges, advocates, counselors, and in other roles. The law governing the conduct of lawyers in these roles is applied in disciplinary and bar admission procedures, and by courts in dealing with issues of appearance, representation, privilege, disqualification, and contempt or other censure, and in lawsuits seeking to establish liability for malpractice and other civil or criminal wrongs committed by a lawyer while acting in a professional capacity.

Test questions covering judicial ethics apply the current ABA Model Code of Judicial Conduct (CJC). Other questions will deal with discipline of lawyers by state disciplinary authorities; in these questions, the correct answer will be governed by the current ABA Model Rules of Professional Conduct (MRPC). The remaining questions, outside the disciplinary context, are designed to measure an understanding of the generally accepted rules, principles, and common law regulating the legal profession in the United States; in these questions, the correct answer will be governed by the view reflected in a majority of cases, statutes, or regulations on the subject.

What do you bring for the MPRE?

The following items are REQUIRED for admission to your MPRE test center:

  • Government-Issued Photo ID (US driver's license, passport, US military ID, US alien registration card)
  • Secondary ID (e.g. school/university/collage ID, credit card, library card)

If you do not present both a valid government-issued ID AND an acceptable secondary ID, you may be prohibited from testing. If you are allowed to test your score may be cancelled.

Where does the MPRE fall with other required exams?

The MPRE is required for admission to the bars of all but three U.S. jurisdictions (i.e. Maryland, Wisconsin, and Puerto Rico).

Generally, applicants may take the MPRE anytime after completing their first year of law school and there is no requirement that the MPRE be taken before the bar exam.

However, the MPRE requirement must be satisfied with the required passing score before a motion is made to the state seeking certification of eligibility to practice law in the jurisdiction.

What is the MPRE?

The Multistate Professional Responsibility Examination (MPRE for short) is a multiple-choice exam administered to law students. The MPRE consists of 60 question, 50 of which will be scored and 10 will be used for experimental purposes, taken in 120 minutes.

Unlike the bar exam, students can sit for the MPRE while still attending law school, and the score is transferable between jurisdictions.

Studying for the MPRE won’t be as time-consuming as studying for the bar exam, but it’s important to put in the hours to make sure you pass the first time. While the raw score will range between zero and 50, scores will be scaled according to the exam’s difficulty. Thus, the final score will fall between 50 and 150, with the median usually falling around 100. Passing scores vary state to state, ranging from 75-86 depending on the jurisdiction. Thus, over 50% of test takers are expected to pass.
