(D) is correct because the passage suggests that judges tend to respect a completely non commercial research exception to patent infringement (lines 51-54), suggesting that even if this researcher is sued, the judge will likely find him/her not liable.

(C) is incorrect because it is an unwarranted inference, the author never talks about the university/ research institution's perspective and risk tolerance when it comes to basic research using patented materials.
