Answer choice (D) is incorrect because we are not told that there have actually been any conflicts over the management of water resources. We know that the ILC was motivated to develop the Draft Articles because they recognized the need for legal and institutional mechanisms to facilitate international cooperation in the management and protection of rivers (lines 7 to 16). However, this is because "...the growing importance of water in geopolitical affairs has increased the potential for international conflict over water resources" (lines 5 to 7).

Therefore, we know that the potential for conflicts over the management of water resources has increased; however, we cannot be sure that actual conflicts have occurred as suggested by answer choice (D).

I am confused how I would gather that "much of the content of the Draft Articles had already been articulated by courts resolving international water-rights cases" from "...the growing importance of water in geopolitical affairs has increased the potential for international conflict over water resources"

That sentence from the paragraph doesn't communicate that it has already been articulated by the courts. I would take from that the growing importance in politics had increased the potential ...

Hi @NJP, I would take a look at the first sentence of the second paragraph. It states that the draft articles were an attempt to codify principles that were already accepted in international law and legal practice.
