Not an instructor here and I also had a similar question. I think the beginning of 2nd paragraph does suggest that the Draft is manifested in"past legal decisions" regarding the issue. However, I still don't know where we can draw that "much of content" had been articulated by the court? I hope this helps a little...FS101 on June 25, 2021

Lines 19-22 tell us that Most of the treaty was existing court decisions, and the treaty was codifying it into law rather than just precedent.
