Clarification on wrong answer

I picked the correct answer for this with confidence, with that said,"dutifully enforced" briefly caught my eye. The reason I eliminated this and went with A is that I believed it was out of scope. Is that all I should have taken from that, or is there a further distinction that can be made?

I personally hate the phrase out of scope, because the reason an answer is wrong is WHY it's out of scope, not just that it is. So, the question is if the author is referring to how existing laws are applied, or to changing laws. Even if it's not clear from the immediate context, later on in the third paragraph we are told that copyright holders want to change the laws. Thus, dutifully enforced is wrong because the passage isn't suggesting that holders want better enforcement, but rather, different laws.
