Delaware Bar Exam Overview

DE Essay Questions

Each three-hour essay session consists of four 45-minute essay questions. This part is designed to measure an applicant's ability to analyze legal issues arising from fact situations.

Answers are expected to demonstrate the applicant's ability to analyze the facts of the question, to tell the difference between material facts and immaterial facts, and to discern the points of law and fact upon which the question turns. The answer must show knowledge and understanding of the pertinent principles and theories of law, their qualifications and limitations, and their relationships to each other.

The answer should evidence the applicant's ability to apply the law to the given facts and to reason in a logical, lawyer-like manner from the premises adopted to a sound conclusion.

An applicant should not merely show that he/she remembers the legal principles, but should demonstrate his/her proficiency in using and applying them.

Multistate Performance Test (MPT)

The Multistate Performance Test (MPT) is developed by NCBE and consists of two 90-minute items. It is administered by user jurisdictions as part of the bar examination on the Tuesday before the last Wednesday in February and July of each year.

The MPT is designed to test an examinee's ability to use fundamental lawyering skills in a realistic situation and complete a task that a beginning lawyer should be able to accomplish. The MPT is not a test of substantive knowledge. Rather, it is designed to evaluate certain fundamental skills lawyers are expected to demonstrate regardless of the area of law in which the skills arise.

Multistate Bar Exam (MBE)

The MBE, which is administered on Wednesday, is developed and graded by the National Conference of Bar Examiners (NCBE).

This portion of the examination is an objective 6-hour examination containing 200 multiple-choice questions, which is divided into two 3-hour sessions during which 100 questions are administered.

The MBE tests 7 subjects: Civil Procedure, Constitutional Law, Contracts, Criminal Law & Procedure, Evidence, Real Property, and Torts.

Grading

NCBE scores the MBE component of the UBE. Jurisdictions grade the MEE and MPT components. The MEE and MPT scores are scaled to the MBE and UBE total scores are calculated by NCBE.

A passing score of 145 out of a scale of 200 is required, based on the combined scaled scores of the MBE portion and the written portion.

Results

Results for the July exam are released in early October.

Reciprocity

MBE Transfer

Delaware does not accept MBE scores taken previously. All applicants must take the MBE as part of the exam in Delaware.

Admission on Motion

Delaware does not allow for admission on motion. All persons must take and pass the Delaware Bar Exam, complete the clerkship requirements, and establish their character and fitness to practice law in order to be admitted to the Bar of the state of Delaware. There are no different procedures for persons admitted in other jurisdictions.

The "Attorneys' Examination" is the California Bar Examination for which attorney applicants may apply, provided they have been admitted to the active practice of law in a United States jurisdiction at least four years immediately prior to the first day of administration of the examination and have been in good standing during that period.

The Attorneys' Examination includes essay questions and performance tests of the General Bar Examination but not its multiple-choice questions (i.e. MBE).
